James Cameron describes deepest spot in ocean as 'barren' (+video)

Filmmaker James Cameron became the first person to make a solo dive to Challenger Deep, the deepest known point in the ocean, in a custom-built submersible.?

The director of "Titanic" and "Avatar" successfully completed the 6.8-mile dive to the Challenger Deep, thought to be the lowest point on Earth, and has returned to the surface. The filmmaker's verdict on the spot, which has been visited by humans only once before:?"I just sat there looking out the window, looking at this barren, desolate lunar plain, appreciating," Cameron told the Associated Press.

In other words, he didn't see much, save for a few inch-long amphipods, shrimplike bottom feeders, scuttling across the soft ocean floor. Due to a hyraulic failure on his submarine's sample collector, Cameron was also unable to bring back much in the way of souvenirs.?

Cameron is just the third person in history to visit Challenger Deep, which lies in the 1,500-mile-long Mariana Trench in the North Pacific. The other two adventurers, US Navy lieutenant Don Walsh and Swiss scientist Jacques Piccard, took their dive together in 1960. But they didn't see much, as their landing stirred up so much sediment that it obscured their vision. After just 20 minutes on the bottom, the two explorers returned to the surface empty-handed.

Unlike the vehicle that transported Walsh and Piccard, Cameron made his trip in the Deepsea Challenger, a vessel that is much taller than it is wide. This unique, 24-foot-long ship took eight years to build in Australia. It's cost hasn't been disclosed.

The vessel is innovative in several ways. To protect against the potentially crushing pressure in the deep sea, the project's lead engineer, Ron Allum, designed a new foam flotation material Isofloat that will not crack, compress or lose buoyancy on the journey. This foam makes up 70 percent of the submersible's volume.

Other important components of the sub are its lights and cameras. Cameron captured hi-resolution 3D footage during his dive.?

Scientific feats such as trips to the bottom of the sea, are most commonly tackled by governments and scientific organizations. And other entrepreneurs like Richard Branson are also trying to get to the deepest part of the sea.

But Cameron has distinguished himself. Not only does he have access to the necessary fiscal resources, but his talent with a camera, curiosity and adventurous spirit set him apart.

?Imagination feeds exploration,? Cameron said, according to National Geographic, one of the trip's sponsors, before the journey. ?You have to imagine the possible before you can go and do it.?

Though he has the necessary skills for the job, Cameron's physical attributes provided some challenges: All six feet, two inches of Cameron were?crammed inside a metal sphere with a diameter at the surface of just 43 inches. During the dive,?Cameron reported that his sub shrank by three inches, due to the immense pressure. ?

"I can't say it's very comfortable," Cameron told the AP. "And you can't stretch out."

Bobby Brown has been arrested on suspicion of driving under the influence.

Authorities pulled over the ex-husband of the late Whitney Houston on Monday afternoon at 12:20 p.m. at the intersection of Victory Blvd. and Wilbur in the Van Nuys/Tarzana, Calif., neighborhood, Access Hollywood has confirmed.

Brown was pulled over for talking on his cell phone, but officers gave him a field sobriety test, according to Officer Mike Harris of the California Highway Patrol.

The New Edition singer allegedly failed the sobriety test and was taken to the Van Nuys jail where he was charged and booked for suspicion of DUI.

Responding to a request for comment from Access Hollywood on Monday afternoon, Brown?s manager told Access that the singer had been released from jail and was home following the incident.

This is not the first time Brown has been arrested on suspicion of DUI. He previously faced a DUI charge in the late 1990s, and eventually served time in jail on the charge in the early 2000s.

LG Electronics has renewed talks with Taiwan-based handset ODMs for the production of inexpensive Android smartphones amid its ongoing efforts to rekindle its smartphone business that will also emphasize LTE-enabled and quad-core models, according to industry sources.

LG reportedly has set a goal to ship 35 million smartphones, including eight million LTE models, in 2012, increasing 50% from a year earlier, the sources noted.

Since the beginning 2012, LG has moved offensively to the mid-range and high-end segments, including the launch of its first quad-core Optimus 4XHD, the 5-inch Optimus Vu and the Optimus 3D MAX, in addition to its L-style series.

However, even if LG reaches its goal of shipping 35 million smartphones this year, the company will still lag far behind Apple and Samsung Electronics as well as Nokia, HTC and Sony Mobile Communications, and could also be outperformed by Huawei Devices, in the segment. In fact, LG may only manage to push up its share in the global smartphone sector to 5-6% in 2012, up slightly from 4-5% in 2011, the sources estimated.

LG is now in talks with Compal Communications and Arima Communications for possible cooperation in the production of entry-level and mid-range Android phones, noted the sources. But volume shipments from Taiwan ODMs to LG will begin at the end of 2012 at the earliest if talks with the two ODMs proceed smoothly, said the sources.

Matt Gelb of the Philadelphia Inquirer reports that Howard?s first post-boot workout involved fielding ground balls at first base while sitting on a stool, so he?s obviously still nowhere near being game ready at this point.

Howard?s timetable was pushed back because of an infection months after the surgery, leading to speculation that he?ll miss all of April and most of May at the very least. Jimmy Rollins even expressed some doubt about the slugging first baseman playing at all this season, but barring more setbacks June seems like a reasonable target date.

After adding live TV streaming features to the DirecTV iPad app last fall, the company is expanding the feature today by pushing an upgrade that lets viewers watch video (but no live TV, yet) even when they're away from home. Dubbed DirecTV Everywhere, it follows up on the company's promises of more video for customer's mobile devices, offering "selected" video on-demand programming for on the go viewing. The Solid Signal Blog has an early preview of the new features with more screenshots and a video, revealing that available content at the moment consists of premium movie channels (HBO networks, Starz, Sony Movie Channel) and DirecTV's own Audience Network. While we wait for more content, other new features include the What's Hot social module pulling from your Twitter and Facebook friends to see what they're watching, and social checkins with Miso. We haven't gotten any official info from DirecTV on the upgrade beyond the changelog, but for now you can check out iTunes for the details.

Griffin's leaf-nosed bat, a newly identified species from Vietnam, has a bizarre set of leaflike protuberances arrayed around its nose.

A brand-new species of leaf-nosed bat has been identified in Vietnam, on the basis of its genetic differences as well as its sonar frequency. The findings, reported in the Journal of Mammalogy, suggest that different bat species living in the same habitat keep to their own in part due to the echolocating sounds they emit.

The new species?? Griffin's leaf-nosed bat, also known by the scientific name Hipposideros griffini ? is slightly smaller than its close cousin, Hipposideros armiger, the great leaf-nosed bat. During a three-year bat survey, researchers found 11 specimens of the new species on Cat Ba Island in Ha Long Bay in northern Vietnam, and in Chu Mom Ray National Park on the mainland, more than 600 miles (1,000 kilometers) to the south.

Like its bigger cousin, Griffin's leaf-nosed bat a bizarre-looking array of leaflike facial protuberances that are thought to enhance the echolocation signals it sends out to avoid obstacles and scan for potential prey. But a computerized analysis of bat calls determined that the smaller bat emits its signals in a slightly higher frequency: 76.6 to 79.2 kHz, as opposed to the range of 64.7 to 71.4 kHz for several subspecies of the great leaf-nosed bat. The researchers said H. griffini's call is distinguishable from all other known leaf-nosed species in its habitat, which means the frequency could be used to identify the bat in future field studies.

Lead researcher Vu Dinh Thong of the Vietnam Academy of Science and Technology said there were other differences as well.

"While captured, some similar body-sized bats, i.e. great leaf-nosed bat, reacts very angrily," he told National Geographic in an email. "But Griffin's leaf-nosed bat seems quite gentle."

The research team confirmed their suspicions that the gentler, smaller, higher-pitched bat represented a different species by analyzing the bats' mitochondrial DNA, according to the journal report. The species was named after the late Rockefeller University researcher Donald Redfield Griffin, who played a leading role in the echolocation research that helped in the identification. H. griffini joins more than 70 other species in the genus Hipposideros.

So, AMD's 2012 rampage continues. Having outed a full stack of Radeon HD 7000-series graphics cards on the consumer side of things, it's now ready release the next in its line of Opteron enterprise server chips. Like the 4200 and 6200 series before it, the Opteron 3200 is based on the Bulldozer architecture. It comes in four or eight-core configurations, with 45W to 65W power consumption, plus a 2.7GHz base frequency that gets a 1GHz adrenalin kick in Turbo Core mode (which prioritizes half the cores and shuts down the other half). However, the 3200 series is designed to offer cloud and web hosting server functionality in a cheaper, "desktop-like infrastructure", which means these processors squeeze into a regular AM3+ socket and undercut comparable Xeons by up to $90. Can we expect server builders like SeaMicro to switch to these processors instead of Intel? Oh, you can count on it.

Bears' wounds heal as they sleep

Black bears have a surprising capacity to heal as they hibernate, say researchers in the US.

Medical researchers and zoologists worked together to find that the bears' wounds healed with almost no scarring, and were infection-free.

The scientists hope, eventually, to find out exactly how the bears' bodies heal while their body temperature, heart rate and metabolism are reduced.

This could aid studies of human wound-healing.

The findings, published in the journal Integrative Zoology, are of particular relevance to medical researchers hoping to improve slow-healing and infection-prone wounds in elderly, malnourished or diabetic patients.

This study was part of a project by scientsts from the universities of Minnesota, Wyoming and the Minnesota Department of Natural Resources, who have tracked 1,000 black bears, in order to monitor their health and behaviour, for 25 years.

Whilst tracking the bears - using radio collars - the researchers noticed some early evidence of their surprising healing abilities.

They wrote in their paper: "We identified a few animals each year with injuries resulting from gunshots or arrows from hunters; bite marks from other bears or predators...

"These wounds were considered to have been incurred some time before the bears denned, and were often infected or inflamed... in early winter.

"Yet typically, when we revisited bears in their dens a few months later, most wounds had completely resolved whether or not we [cleaned them], sutured the areas or administered antibiotics."

To test the bear's healing abilities experimentally, the team carefully tracked the healing of small cuts on the skin of 14 of their radio-collared bears in northern Minnesota.

Between November (when the bears first settled down in their dens) and March (about a month before they emerged) the wounds healed with "minimal evidence of scarring".

Added to this, there were no signs of infection, the layers of damaged skin regrew and many of the bears even grew hair from newly formed follicles at the site of their injuries.

One of the researchers, Prof David Garshelis from the University of Minnesota, told BBC Nature: "It seems so surprising to us that their wounds would heal so well and so completely when they're hibernating and their metabolism is slowed down.

But, he added, the animals had many other "remarkable adaptations to hibernation".

"They sit in the den for six months and don't lose any appreciable muscle or bone mass, so I guess this healing is another adaptation," Prof Garshelis said.

During its winter hibernation, a black bear's core body temperature is reduced by as much as 7C and their heart rate lowers dramatically. In humans, a lowered body temperature, or conditions that hamper circulation can seriously complicate wound-healing.

For this reason, the team hope to find out the mechanism behind the bears' remarkable healing abilities.

He told BBC Nature: "We consider this to have implcations for medical research.

"If we can work out how the bears heal, we hope there'll be potential to translate this research to [studies of] human healing."

This could be especially important for the development of treatments for slow-healing skin wounds in malnourished, hypothermic, diabetic and elderly patients.

Presumption of authorship: only natural persons | Kluwer Copyright ...

Estonian Supreme Court, 7 February 2012, Case No3-2-1-155-11,? Herlitz PBS AG vs. Realister O? (plaintiff in the prededing proceeding).

The Estonian Supreme Court found in its recent judgement in the Realister case that the presumption of authorship as laid down in the Sections 4(6) and 29(1) of the Estonian Copyright Act (hereinafter referred to as the CA) is only applicable in case the right holder relying on the presumption of authorship is a natural person, who has created the work, not a legal person who has obtained the economical rights under the law or a contract.

In this case the owner of the authors? economical rights is a legal person that claims to have economical copyrights regarding a selection of mathematical and chemical formulas reproduced on the cover of school exercise books, therefore the Supreme Court took the position that the burden of proof must rely on the person who claims to be the holder of authors? economical rights, i.e. plaintiff, Realister O?, in this case.

The Supreme Court reasoned that the author of a work is a natural person (or persons), who created the work and that copyright shall belong to a legal person only in the cases prescribed in the CA. Section 4(6) of the CA stipulates that the protection of a work by copyright is presumed, except if, based on this Act or other copyright legislation, there are apparent circumstances which preclude this. The burden of proof lies on the person who contests the protection of a work by copyright. Section 29(1) of CA provides that the authorship of a person who publishes a work under his or her name, a generally recognised pseudonym or the identifying mark of the author shall be presumed until the contrary is proved. The burden of proof lies on the person who challenges authorship.

The Supreme Court pointed out that the concept ?authorship? derives from Section 12(1)(1 of the CA, that provides for a moral right of the author. The Section lays down that the author of a work has the right to appear in public as the creator of the work and claim recognition of the fact of creation of the work by way of relating the authorship of the work to the author?s person and name upon any use of the work (right of authorship).

According to the Supreme Court, it follows from the foregoing analysis that the objective of Section 29 of the CA is only to bind an author as a natural person with his or her creation. As the plaintiff is a legal person, who cannot rely on the presumption of authorship, the defendant cannot be obliged to prove that Realister O? is not the holder of authors? rights. At the same time the Supreme Court did not analyse the presumption laid down in the Section 4(6) of the CA and the concurrence of those two sections referred to above.

In my opinion it might be arguable whether the presumption of authorship should only be applied in cases where the person wanting to rely on this presumption is a natural person. The concept of ?author? in this context might be regarded in a more broader sense than just the natural person.

Such conclusions can also be made on the basis of Section 817 of the CA ?Protection of copyright and related rights under civil law?,? that provides that in the case of the unlawful use of a work or an object of related rights, the author or holder of related rights may, among other, claim the following: 1) compensation, pursuant to ? 1043 of the Law of Obligations Act, for the patrimonial and non-patrimonial damage caused through the unlawful use of a work or an object of related rights; 2) termination of the unlawful use of a work or an object of related rights and refrainment from further violation pursuant to ? 1055 of the Law of Obligations Act; 3) delivery of that which was received by way of the unlawful use of a work or an object of related rights pursuant to ?? 1037 and 1039 of the Law of Obligations Act. It must be emphasized that the Supreme Court in its judgement itself referred to this Section when confirming that also a holder of copyrights (and not only the author as a natural person) is entitled to file claims under this Section.

It might be followed from the foregoing that the term ?author? in the broader meaning in the CA describes also a person who is the holder of authors? rights. The Supreme Court did not explain why in this case the concept ?author? must be interpreted in a narrow sense, not covering the holder of authors? rights.

In addition, it is worth mentioning that in the CA a similar regulation regarding the presumption of related rights has been laid down. Section 62 1 (1) of CA provides that the protection of the object of related rights is presumed, except if, based on this Act or other copyright legislation, there are apparent circumstances which preclude this. The burden of proof lies on the person who contests the protection of the object of related rights. Section 62 1 (2) of CA? stipulates that it is presumed that the person whose name is indicated on an object of related rights as rightholder has rights regarding the specified object until the contrary is proved. The burden of proof lies on the person who contests the fact that this person holds the rights.
