Study upholds breast cancer mortality for hormone replacement

In the nearly 11 years since researchers first rang alarm bells that women on hormone replacement therapy faced an increased risk of breast cancer, some have suggested that taking estrogen and progestin to treat symptoms of menopause might not be so dangerous after all.

Though it was generally agreed that woman who took the two hormones to curb their hot flashes and night sweats upped their chances of developing the disease, many studies suggested that the cancers the women developed were less likely to be deadly.

A new analysis of data from the Women's Health Initiative now casts doubt on those findings. The study, published Friday by the Journal of the National Cancer Institute, concludes that the prognosis for cancers related to hormone replacement therapy is just as dire as for other breast cancers. As a result, women who turn to the treatment are more likely to die of breast cancer than their peers who don't take hormones.

"You could fill a basketball arena with the women who get the disease," said Dr. Rowan Chlebowski, the principal investigator for the Women's Health Initiative and lead author of the new study. "It seems like you'd want to reach a higher threshold before you take it."

Nearly 70,000 postmenopausal women participated in randomized clinical trials as part of the Women's Health Initiative project. The study participants who took estrogen plus progestin had higher rates of breast cancer diagnoses and of breast cancer deaths.

At the same time, more than 90,000 additional women took part in a related observational study that tracked details about their health and hormone use over an average of 11 years. Along with many other observational studies, this one found that women who took hormones to treat menopause symptoms and got breast cancer were less likely to die from the illness than women who got breast cancer without taking hormones.

Chlebowski, an oncologist based at the Los Angeles Biomedical Research Institute in Torrance, suspected that the discrepancy could have resulted from key differences between the women in the randomized trial and the women in the observational study.

So he and his team identified a subset of more than 41,000 women from the observational study who more closely matched the women who took part in the randomized trial. In doing so, the researchers set aside data on women who were not using hormones when they participated in a study but had taken them in the past ? a factor that had the potential to complicate the findings.

The new results fell more closely in line with the findings from the original randomized trial: Survival after breast cancer was similar for both hormone users and non-users. Tumors that arose in women who took hormones were no less deadly.

They had appeared to be, however, because women who had taken hormones years before might have already developed aggressive cancers and would not have been able to participate in the study in the first place. Because of the study design, they had been selected out, Chlebowski said.

Dr. Patricia Ganz, director of cancer prevention and control research at UCLA's Jonsson Comprehensive Cancer Center, applauded the new study's rigor.

"If you're going to take these therapies, you need to know there's an increased risk," said Ganz, who was not involved in the study. "Make sure there's a good indication. And don't take them for a long period of time."

The new findings apply only to women who take estrogen and progestin, a synthesized form of the natural hormone progesterone. Women who have had hysterectomies can take estrogen alone, a regimen that doesn't seem to increase breast cancer risk. But those who still have a uterus must take both estrogen and progestin to avoid developing endometrial cancer.

When the Women's Health Initiative was launched in 1993, about 40% of postmenopausal women were taking hormones. Many of them ? and their doctors ? believed they'd get benefits including improved bone, cardiovascular and cognitive health, Chlebowski said.

As research revealed that was not the case, and that the treatment was associated with cancer risk, the number of users fell by half, to about where it remains today.

Dr. Joanne Mortimer, director of the Women's Cancers Program at City of Hope Cancer Center in Duarte, said that in general, she does not recommend hormone replacement therapy for patients with menopause symptoms.

But Mortimer, who was not involved with the study, said she does discuss the pros and cons of the treatment with "the ones who are up all night with hot flashes and want to kill people. There are still women on it and they will cut your arm off if you take it away."

For a certain percentage of women, she added, hormones provide the only relief.

Last year, a coalition of women's health groups led by the North American Menopause Society, the American Society for Reproductive Medicine and the Endocrine Society issued a statement reiterating that hormone therapy was "still an acceptable treatment for menopausal symptoms." They called the treatment "relatively safe."

FBI 'flying saucers' NM memo bureau's most viewed

ROSWELL, N.M. (AP) ? An FBI report of "flying saucers" in New Mexico sent to then-Director J. Edgar Hoover in 1950 has become the most popular file in the bureau's electronic reading room.

The Roswell Daily Record reports (http://bit.ly/1647qm6) the memo sent by FBI Washington, D.C.- field office chief Guy Hottel has been viewed nearly a million times.

The document is about a report of three flying saucers allegedly recovered in New Mexico, each occupied by three small human-shaped bodies. It says an informant told officials that the UFOs had ended up there because a government radar in the area interfered with their controlling mechanisms.

The FBI never followed up on the report.

The memo is available in the "The Vault," an electronic reading room launched by the FBI in 2011 that contains around 6,700 public documents.

Asia stocks modestly higher after S&P hits record

BANGKOK (AP) ? Asian stock markets were mostly higher Friday as momentum carried over from yet another record high on Wall Street.

Trading remained thin, however, as stock, bond and commodities markets were closed for Good Friday in the U.S. and Europe, along with large parts of Asia.

The Standard and Poor's 500 index closed Thursday at its highest level, driven by more encouraging data on the U.S. economic recovery. The government said the economy grew at an annual rate of 0.4 percent in the October-December quarter, slightly better than previous estimates. The revision reflected stronger business investment and export sales.

Those markets open in Asia reflected the good news out of the U.S.: South Korea's Kospi rose 0.6 percent to 2,004.89. Taiwan's TAIEX advanced 0.7 percent to 7,918.61.

Japan's Nikkei reversed early losses to rise 0.5 percent and close at 12,397.91. Gains were muted, however, as the yen leveled off against the dollar and the government released figures for February showing the country's jobless rate edging up while industrial production fell slightly.

Newly appointed central bank governor, Haruhiko Kuroda, has pledged to work with the government to end decades of growth-inhibiting deflation. His outspoken calls for action have raised hopes for results but some analysts said they may also have created unrealistic expectations for a turnaround.

"Unfortunately, the markets' expectations of the new Governor are so high that they will be almost impossible to meet, let alone beat," said analysts at Capital Economics in a market commentary.

Shares in mainland China were mostly flat amid limited trading volume, analysts said. The Shanghai Composite Index was nearly unchanged at 2,236.62 while the Shenzhen Composite Index fell 0.2 percent to 927.89.

Peng Yunliang, a Shanghai-based analyst, said shares in brokerage houses declined following the release Thursday of official policies aimed at tightening control over wealth management products.

Markets in Hong Kong, India, Australia, New Zealand, Indonesia, Philippines and Singapore were shut for Good Friday.

In Europe on Thursday, markets responded positively to the calm reopening of Cyprus's banks. Banks in the Mediterranean island nation were shut for nearly two weeks as the government negotiated a rescue loan from international lenders to prevent the financial system from collapsing.

However, Italy's political uncertainty will also remain in the spotlight. Following inconclusive elections around a month ago, the country is still without a government, and that's raised concerns over its future economic path.

In currencies, the euro was up slightly to $1.2824 from $1.2822 late Thursday in New York. The dollar fell to 94.09 yen from 94.13 yen.

The New York Mercantile Exchange, where benchmark oil is traded, was closed for the Good Friday holiday.

3 Strategies for Managing the Skyrocketing Cost of College

Today's college students are paying twice as much for higher education as students paid a quarter-century ago -- and 50 percent more than students paid just four years ago, according to the State Higher Education Finance report recently released by the State Higher Education Executive Officers.

At the same time, despite a high demand for college (97 percent of Americans say having a degree or certificate beyond high school is important), three-quarters of Americans don't believe that higher education is affordable for everyone who needs it, according to a study by the Lumina Foundation.

Although this is certainly bad news for anyone contemplating college, the good news is that according to a report from the Georgetown University Center on Education and the Workforce, getting a degree will almost certainly pay off in a higher salary and more job security. The report, The College Advantage, has loads of great information about the benefits of earning your degree.

If you're worried about the plunge you're about to take, here are three strategies you might consider to keep your debt to a manageable level.

1. Consider community college: Tuition is typically lower than at public colleges and universities, and you can often transfer your credits to a four-year school if your goal is a bachelor's degree or higher. Many scholarships are available to students who are studying at community colleges; there are also scholarships for students transferring into four-year colleges.

2. Add cost to your selection criteria: Today's students may not have the luxury of judging a college only by academic or social fit. Adding cost to the equation will most certainly help you sleep better at night after making your decision -- and while you are paying off your loans later.

When considering cost, understand the sticker price -- but also understand what the college will offer in terms of discounts, how it will view your outside scholarships and how to make sure the institution treats those scholarships fairly. Kim Kardashian and Kanye's baby will not be named North West, the E! reality star told Jay Leno on Thursday's "Tonight Show." But they're not necessarily going in another direction with the moniker.?

"You know what name I do like, but it probably won't be on (our list)?" she told the host. "I do like --because it kind of goes with North -- I like Easton. Easton West. I think that's cute."

Leno, obviously trying for a big gender reveal, asked, "Isn't that a boy's name?"

"Boys' names are good for girls," she said coyly.

Boy or girl -- and our money's on the latter -- Kim insists her infamous "momager," Kris Jenner, "will not be handling anything for the baby."

Dashing (ahem) any hopes for a "Keeping Up With Kimye" spinoff, Kim insisted: "The baby is not hopefully going to do anything in the business or have a show or anything like that."

Prebiotics: Do supplements in baby formula help prevent allergies?

Mar. 25, 2013 ? Prebiotic supplements in infant formula may help to prevent eczema, according to a systematic review published in The Cochrane Library. However, the review highlights a lack of high quality evidence for the effects of prebiotics in preventing allergies.

It is thought that bacteria lining the gut may play an important role in a child developing sensitivities to certain foods and allergens, regulating immune responses and determining how they will react to the same substances in later life. Prebiotics are indigestible components of breast milk, fruit and vegetables that stimulate the growth and activity of healthy bacteria in the gut. They are distinct from probiotics, which are cultures of live bacteria such as those added to yoghurts and infant formula. Prebiotics can also be added to infant formula. However, it is unclear exactly what effect these supplements have on the development of allergies.

The researchers drew together data from four studies involving a total of 1,428 children. Children were given formula containing prebiotic supplements or, as a control, standard formula. Studies followed children to between four months and two years of age and reported the number who developed allergies. Eczema was significantly reduced in children who were fed formula containing prebiotics. Only two studies investigated asthma. The number of children who developed asthma was similar whether they were given formula with added prebiotics or without. In one study looking at urticaria (hives), giving children formula containing prebiotics did not prevent any cases of the allergy.

Only one study assessed the effect of giving formula containing prebiotics to high-risk children, who had close family members with allergies. In this study, prebiotics reduced both eczema and asthma, but there were no significant reductions in allergies overall in high-risk children. "Given these findings, it remains unclear whether the use of prebiotics should be restricted to infants at high risk of allergy or may have an effect in low risk populations," said lead researcher, John Sinn of the University of Sydney in Sydney, Australia.

"Overall, we found some evidence that infant formula containing prebiotic supplements can help prevent eczema in children up to two years of age," said Sinn. "However, the quality of existing evidence is generally low or very low. More high quality research is needed before we can recommend routine use of prebiotics for prevention of allergy."

Quality preschool benefits poor and affluent kids, study finds

Quality prekindergarten programs can boost children?s school skills whether the kids come from poor or well-off homes, a new study shows.

While previous studies had focused only on kids from underprivileged backgrounds, in the new study Harvard researchers found that regardless of family income children who got a year of quality prekindergarten did better in reading and math than kids who spent the year in daycare, with relatives, or in some other kind of preschool, according to the report which was published in Child Development.?

As a further benefit, the kids who spent a year in preschool developed better ?executive functioning.?

That means is that they had developed the skills needed to take advantage of what is being taught in school, said the report?s lead author Christina Weiland, a researcher at Harvard when the study was done and currently an incoming assistant professor at the University of Michigan.

?For example, they?ve learned that they need to raise their hands before yelling out an answer,? she explained. ?They?ve gotten better at keeping numbers in their heads when doing a math problem and remembering the teacher?s instructions. They?ve gotten better at shifting their attention from a distracting peer to what the teacher is saying.?

Those kinds of self-regulatory behaviors are highly predictive of how well you do later in life, Weiland said.?

There were some kids who benefited more than others from prekindergarten: Latino children, and to a lesser extent, Asian and African American children.

Weiland was able to study the impact of preschool in a sort of ?natural? experiment. In Boston, kids qualify for a free, full-day preschool program during the school year?if they turn 4? by Sept. 1.

Children born after that date must wait a year before they are eligible.

For the study, Weiland tested 969 kids who'd finished?a full?school year of preschool in?2008-2009 and compared them 1,049 kids?who?weren't quite old enough to have made the previous year's?cutoff and so were just starting preschool.?(Many of them had spent that?year in daycare and being cared for by relatives or in other preschool programs.)

Experts unaffiliated with the new research welcomed the new report.

?I think this is a very important study since the effects weren?t just in children at a lower economic level,? said Patrick Tolan, a professor in the Curry School of Education and director of the Youth-Nex Center at the University of Virginia. ?Just as important, though, is the implication that the boost in skills may very much depend on having high quality staff and using programs that have been empirically tested.?

Matia Finn-Stevenson, a research scientist and associate director of the Zigler Center in Child Development and Social Policy and director of the School of the 21st Century at Yale University, agreed that the quality of the program is all important.

?In this study the children were in a high-quality educational environment with teachers with masters degrees, teachers receiving coaching, etc.,? she said. ?I know parents who are not satisfied with their PreK and they have told me they simply have to look the other way and not make waves because they have no alternatives.?

How can parents figure out whether their PreK program is good?

Finn-Stevenson suggests that ?parents should look for a place that allows parents to come in at any time to see the PreK in action. Look for staff continuity ? how long have they been at the school/program? How often and in what ways do they interact with the children? What is the overall atmosphere? How are the children interacting??

One thing that?s unclear at this point is whether the gains in PreK will carry over into later years. That?s a topic that still needs to be researched, Tolan said.

8. View photos of your products are clearly on your website or blog

Consumers who buy things online will want to see the product photo first. Therefore, you must provide photos of the items with detailed specifications for them.

9. Selectively choose the delivery service company

Choose only with the reliable delivery service so that the items ensured received into the hands of buyers on time and without damage or reduced in number.

10. Give assurance

David Petraeus apologizes for conduct, affair

LOS ANGELES (AP) ? David Petraeus apologized Tuesday night to an audience of many veterans for the conduct that led to his resignation as head of the CIA following the disclosure of an extramarital affair.

"Needless to say, I join you keenly aware that I am regarded in a different light now than I was a year ago," Petraeus said. "I am also keenly aware that the reason for my recent journey was my own doing. So please allow me to begin my remarks this evening by reiterating how deeply I regret ? and apologize for ? the circumstances that led me to resign from the CIA and caused such pain for my family, friends and supporters."

He made the comments during his first public speech after his resignation, to a group of about 600 people, including many veterans at the University of Southern California's annual ROTC dinner. The hero of the Iraq and Afghanistan wars has remained largely in seclusion since resigning.

His lawyer, Robert B. Barnett, has said that Petraeus has spent much of that time with his family.

Petraeus received applause and a standing ovation before he began the evening's program by cutting a cake, a task reserved for the highest ranking person in the room.

His affair with the retired four-star general's biographer, Paula Broadwell, was discovered during an FBI investigation into emails she sent to another woman she viewed as a rival for his attention.

At the time, Petraeus told his staff he was guilty of "extremely poor judgment."

"Such behavior is unacceptable, both as a husband and as the leader of an organization such as ours," he said.

As the military leader credited with reshaping the nation's counterinsurgency strategy, turning the tide in the U.S. favor in both Iraq and Afghanistan and making the U.S. safer from terrorism, Petraeus expected a friendly audience at the ROTC dinner.

At least one expert in crisis communications said that if his apology comes across as heartfelt and sincere, the public will indeed be seeing much more of him.

"America is a very forgiving nation," said Michael Levine who, among dozens of other celebrity clients, represented Michael Jackson during his first child molestation investigation.

"If he follows the path of humility, personal responsibility and contrition, I submit to you that he will be very successful in his ability to rehabilitate his image," he said.

Another longtime crisis communications expert, Howard Bragman, said Petraeus has handled the situation perfectly so far and he expects he'll continue to do so. He noted that unlike former President Bill Clinton, former U.S. Sen. John Edwards and other public figures caught in extramarital affairs, Petraeus didn't try to lie his way out of it, immediately took responsibility and moved on.

"I think the world is open to him now," said Bragman, vice chairman of the image-building company Reputation.com. "I think he can do whatever he wants. Realistically, he can even run for public office, although I don't think he'd want to because he can make more money privately."

Ahead of the speech, Petraeus drew lavish praise from USC's president, C. L. Max Nikias, who called him "arguably the most effective military commander since Gen. Dwight D. Eisenhower."

"In our post 9/11 world, Gen. Petraeus' influence on our military is unmatched, and his contributions to the CIA are far-reaching," Nikias said. "

While at USC, Petraeus also planned to visit faculty and students at the Price School of Public Policy, which administers the ROTC program, and USC's School of Social Work, which trains social workers in how to best help veterans returning from war.

Why the budget iPhone would throw the smartphone market into chaos

The buzz around the budget iPhone has grown deafening, with new reports about the device coming out on a weekly basis. This will be a product launch with a unique impact because of two trends that define the current smartphone market. First, the overall smartphone volume growth is projected to slow down from more than 50% in the fourth quarter of 2012 to about 36% in Q4 2013. Second, the Q4 2012 growth rates of the three biggest Asian smartphone vendors have remained superheated, with Samsung (005930) at 76%, Huawei at 89% and Sony (SNE) at 56%. What made this was possible was Apple?s slowdown to 29% growth during the past Christmas season and the notably weak year-on-year numbers from Nokia (NOK), ZTE and BlackBerry (BBRY).

If the budget iPhone really arrives this summer, it will drop smack in the middle of the tension created by slowing global smartphone volume growth and the extremely ambitious volume growth targets of the largest Asian vendors. Obviously, Sony?s momentum has now improved even more with the smash success of the Xperia Z in Europe and Asia over the past two months. Samsung is about to make a substantial volume leap with the Galaxy S 4 launch in April. It is clear that Samsung, Huawei and Sony are all gunning for 50%-plus volume growth in 2013, even as total smartphone market volume growth is slowing down to 30%.

The quarterly smartphone volumes of Nokia and Blackberry have dropped to 4 and 7 million units, respectively. The new smartphone leaders simply don?t have that much flesh left to rip from the haunches of the two fading champions. The new product lines of Nokia and BlackBerry are highly likely to stabilize their overall quarterly smartphone volumes in coming quarters close to the Q4 2012 level even if the sales are deeply disappointing. More likely, the combined Nokia and BlackBerry market share will actually climb a bit during the first three quarters of 2013. The period of making easy gains off the Nokia-BlackBerry volume dive is over.

That leaves a tough equation for the industry to deal with. The budget iPhone is likely to boost Apple?s year-on-year volume growth for the second half of 2013 to well above 40%, possibly over 50%, even if the model is priced at $350 in retail without subsidies. If it?s priced at or below $300, the volume boost could be a lot bigger. What would that mean for the rest of the field if the global smartphone volume growth continues its cooling, likely to around 30% during the second half of 2013?

Apple is in a unique position because all the other leading brands have made fairly aggressive moves to the budget category a lot earlier. Apple?s average selling price at around $650 is so high that it was initially regarded as impossible for a mass-market phone vendor back in 2007. There clearly is huge pent-up demand for a brand new iPhone retailing at below $400, particularly since the new iPhone model prices tend to top $700 in non-subsidized markets. Because non-subsidized markets make up more than 80% of the global handset markets, the budget iPhone is a big deal indeed.

A lot is now riding on the precise pricing of the cheaper iPhone: The difference between $275 and $375 in retail is fairly massive in markets like Brazil and Russia. But either sort of budget iPhone would completely reshape the Christmas season market share outlook, possibly spelling doom for a variety of mid-tier brands from HTC to LG.

The Nexus 7 has just appeared for sale on the Google Play store in India, with a shipping date of April 5. There hasn't been any official announcement to our knowledge, but a couple of quick people on Twitter found it as soon as it went live in the store -- and it doesn't get much more official than that. If you're in India, you can add it to your cart for Rs. 15,999 (about $295) and have it shipped "by April 5, 2013".

Even though the Nexus 7 may seem like old news to those of us who have had easy access to them for several months, it's a huge deal to see Google finally selling Nexus devices directly to India. Google has been making huge efforts to expand Android's presence in the country, which has been growing its mobile and smartphone usage dramatically over the last year.

Boston Hospital readmissions are a costly problem for patients and for the United States health care system with studies showing nearly 20 percent of Medicare patients are readmitted to the hospital within 30 days of discharge at an annual cost of $17 billion. Preventing avoidable readmissions could result in improved patient care and significant cost savings. In a new model developed at Brigham and Women's Hospital (BWH), researchers help clinicians identify which medical patients are at the greatest risk for potentially avoidable hospital readmissions so extra steps can be taken to keep those patients healthy and out of the hospital. The model is published in the March 25, 2013 online edition of JAMA Internal Medicine.

"The strength of this model is its simplicity," said Jacques Donz, MD, MSc, a research associate in the Department of Medicine at BWH and co-creator of the model. "We have identified seven important variables that a physician can easily run through at a patient's bedside prior to discharge. If a patient is determined to be at high-risk for readmission, a return trip to the hospital could be prevented by providing additional interventions such as a home visit by a nurse or pharmacist consultation.

The seven independent factors, which were discovered over the course of three years of research, include:

  • Hemoglobin level at discharge
  • Sodium level at discharge
  • Whether or not the patient is being discharged from an oncology service
  • Whether or not non-surgical patients had a procedure during their hospital stay
  • Whether or not the hospital admission was elective
  • The number of times the patient has been admitted to the hospital during the last year
  • The length of the patient's hospital stay
The more of these risk factors a patient has, the greater the risk of readmission.

"This model can be a valuable tool in the national effort to reduce health care costs and improve the quality of care," said Jeffrey Schnipper, MD, MPH, the director of clinical research for the BWH hospitalist service and a co-creator of the model. "Identifying patients who at least have the potential to benefit from more intensive transitional interventions is an important first step in reducing hospital readmissions."

Researchers stress that this model predicts the risk of potentially avoidable readmission, and that no prediction model will be a perfect indicator of preventable hospital readmission. Because the model was created and validated at one hospital, a multi-center international validation of the model is now underway.

Judge denies bail in defense secrets case

HONOLULU (AP) ? A federal judge denied bail Monday to a civilian defense contractor accused of giving military secrets to a Chinese girlfriend half his age, saying he poses a danger to national security.

U.S. Magistrate Judge Richard Puglisi ordered Benjamin Bishop, 59, to remain in custody while he awaits trial.

Puglisi cited a declaration made to the court Monday by the U.S. Pacific Command's chief of staff, Maj. Gen. Anthony Crutchfield, in making his decision.

The judge said Crutchfield made the case that Bishop would almost certainly be able to recall substantial amounts of classified information from memory and could divulge classified information that could harm national security.

Bishop is charged with one count of communicating national defense information to a person not entitled to receive it and one count of unlawfully retaining national defense documents and plans.

Federal investigators say he gave his girlfriend, a 27-year-old Chinese national studying in the U.S., classified information about war plans, nuclear weapons, missile defenses and other topics through emails and telephone calls.

The Army Reserve lieutenant colonel was working at the U.S. Pacific Command as a contractor when he was arrested March 15.

Puglisi had asked prosecutors to explain how Bishop, if released on bail, might disclose military secrets when he's been fired from his contractor's position and no longer has access to classified information.

The prosecution responded with a declaration from Crutchfield that outlined Bishop's work in cyber defense, a position he held from May 2011 until his arrest, and his previous job helping develop Pacific Command strategy and policy.

Bishop, through the course of his work, was familiar with the Pacific Command's highest priority capability gaps, the declaration said.

Bishop is also familiar with the way Pacific Command conducts operations, including how it uses cyber security, Crutchfield said.

In a previous position that Bishop held from May 2010 to April 2012, Bishop had access to "top secret" information on the command's efforts to defend against a ballistic missile attack from North Korea, Crutchfield said.

"Unauthorized release of this highly sensitive, classified information could cause exceptionally grave damage to U.S. national security, undermining the value of this huge investment of national treasure," Crutchfield said.

Assistant U.S. Attorney Ken Sorenson argued in documents submitted Monday that there were no conditions that could reasonably assure Bishop won't divulge classified information if he's released on bail.

"Nothing short of the security of the Pacific, and U.S. forces in the Pacific, are placed at risk by the nature of the information known to this defendant," the prosecutor said.

Sorenson argued that electronic monitoring proposed by the defense wouldn't be effective in an era when people can use "secret email or Twitter accounts, covert Facebook identities or disposable cellphones" to communicate.

Sorenson said Bishop has shown he can't be trusted in part because he violated security oaths by failing to tell the government about his contact with the woman. Bishop's security clearance required him to report contact with her because she's a foreign national.

Bishop's attorney, Birney Bervar, said he was frustrated by the ruling. He said his client is considering appealing.

"He's being detained without bail based upon what's in his mind, based upon his knowledge and what he knows," Bervar said. "There's no authority, case law, statutory or otherwise, to lock people up because of what they know, what's in their mind."

The FBI alleges Bishop and the woman started an intimate, romantic relationship in June 2011. In court documents Monday, the prosecution said she is a graduate student and Bishop was having an extramarital affair with her.

State documents in Utah show Bishop was married until last year.
